  • General Position Summary

    Experienced Federal Energy Regulatory Commission (“FERC”) Counsel responsible for supporting PJM’s Mission and Vision in the areas of operations, planning, markets, commercial and compliance.  Working closely with senior lawyers in the department, Counsel will develop, draft, and execute effective regulatory filings and communications to advance PJM’s growing, complex, exciting and progressive agenda before FERC and other federal and state regulatory agencies.  Counsel will have responsibility for coordinating with PJM’s business managers and executing PJM’s regulatory strategies both in PJM’s stakeholder processes and externally.  Counsel will engage in a hands-on regulatory practice before FERC while coordinating closely with other lawyers in the department, outside legal resources and non-lawyer professionals.  Counsel is expected to have extensive knowledge of the decisions and policies of FERC and will assist other attorneys in the department in regulatory and other legal matters.  Counsel will interface directly with PJM’s stakeholders, business managers and Senior Leadership Team to develop positions and resolve legal issues in accordance with established Law Department policies.  Counsel will be specifically responsible for: (1) providing counsel to PJM’s principal business functions consistent with filed tariff, applicable reliability standards organizations, and regulatory rules and precedent; (2) advocacy functions in administrative litigation contexts before federal regulators and other agencies; (3) appear and present before PJM stakeholders; and (4) related civil litigation oversight and management.

    Essential Duties and Responsibilities

    • Analyze, interpret, advise and provide recommendations on legal matters involving PJM.
    • Responsible for coordinating litigation/administrative proceedings in local, state and federal courts/agencies involving PJM.
    • Drafting, editing and electronic filing of PJM pleadings, including tariff filings and other FPA Section 205/206 submissions, interventions/protests, comments to rule changes, compliance filings, and other pleadings in regulatory proceedings.
    • Direct and manage outside counsel on the drafting of other PJM pleadings; direct and manage outside counsel in FERC and other agency proceedings.
    • Report to an Associate General Counsel.
    • Coordinate with the General Counsel, Deputy General Counsel, Associate General Counsel, other law department colleagues, and/or PJM’s business managers to develop and execute PJM’s position and approach in FERC and other regulatory proceedings.
    • Provide general legal advice to various client departments regarding core business functions of planning, operations, markets, commercial and compliance.
    • Contribute to policy formation.
    • External interface on regulatory and legal issues with PJM stakeholders.
    • Collect input and comment on draft pleadings (including those prepared by outside counsel) directly from business clients and either incorporate them into the draft pleadings or coordinate an organized response back to outside counsel for incorporation into the drafts.
    • Coordinate responses to discovery requests when received by PJM and the issuance of discovery requests on PJM’s behalf.
    • Provide legal counsel, advice and representation in tariff, reliability standards and regulatory compliance proceedings, audits and investigations.
    • Appear as counsel of record on PJM matters before FERC and other regulatory agencies, including hearings, technical conferences, settlement conferences, open meetings, etc.
    • Review, edit and revise pleadings prepared by outside counsel and oversee legal matters on which PJM retains outside counsel.
    • Monitor Commission decisions and report in all areas that may impact PJM’s business interests.

    Characteristics and Qualifications

    Required

    • Juris Doctor (JD) degree
    • At least 4 years of experience broad legal experience including prior mix of energy regulatory and commercial in-house experience or FERC regulatory administrative experience with private firm.
    • Ability to produce high-quality work products with attention to detail
    • Experience with legal research and writing
    • Experience in litigation matters
    • Experience working with a regulatory agency, law firm or in a legislative setting
    • Must be licensed to practice law and able to be admitted to the State Bar of Pennsylvania


    Preferred

    • MBA, Business Administration
    • Experience with PJM Agreements and Tariffs
    • Experience with PJM operating agreements and neighboring systems
    • Experience with PJM operations, markets, and planning functions
    • Experience assisting in the preparation and filing of documents in federal or state regulatory proceedings
    • Experience with PUC and state regulatory laws, coupled with a general understanding of the electric utility industry
